These Terms of Service (the “Agreement”) are an agreement between simple-webhosting.ca (“simple-webhosting.ca”, “us”, “we”, or “our”) and you (“User”, “you”, or “your”). This Agreement sets forth the general terms and conditions of your use of the products and services made available by simple-webhosting.ca and of the simple-webhosting.ca website (collectively, the “Services”). By using the Services, you agree to be bound by this Agreement. If you do not agree to abide by the terms of this Agreement, you are not authorized to use or access the Services.
Additional Policies and Agreements
Use of the Services is also governed by our Payment/Refund Policy, Privacy Policy, Acceptable Use Policy, Anti-Spam Policy, and Domain Registration Agreement. By using the Services, you agree to these terms.
Account Eligibility
You must be at least eighteen (18) years of age to use our Services. If you use the Services on behalf of another entity, you represent that you are authorized to bind that entity. You agree to provide accurate, current, and complete information. simple-webhosting.ca is not responsible for service interruptions caused by inaccurate account information.
Transfers
We may assist with migrating your website from another provider. Transfers are provided as a courtesy when possible, but we do not guarantee the availability, success, or completeness of any transfer. simple-webhosting.ca is not liable for any lost or missing data or files during transfers. You are solely responsible for maintaining your backups.
Content Ownership
Except for User Content, all materials provided through the Services are the property of simple-webhosting.ca or its licensors. You may not modify, copy, or distribute this content except as expressly permitted. All rights not expressly granted are reserved.
User Content
You are solely responsible for all content you upload or host. You represent that you have all necessary rights to such content and that it does not violate third-party rights. You grant simple-webhosting.ca a limited, worldwide, royalty-free license to use and display your content solely for the purpose of providing the Services. simple-webhosting.ca may remove or disable access to content that violates our policies or applicable law.
Privacy and Data Protection
simple-webhosting.ca complies with the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial privacy laws. By using our Services, you consent to the collection, use, and disclosure of personal information as described in our Privacy Policy. We will take reasonable measures to protect your data, but you acknowledge that no online service is completely secure.
Domain Registration
When registering or managing .ca domains, you must comply with the rules and policies of the Canadian Internet Registration Authority (CIRA). Domain renewals are billed thirty (30) days before expiration. You are responsible for maintaining current contact information for domain ownership.
Billing and Payment
You agree to pay for all Services in advance of the time period during which such Services are provided. All fees are in Canadian dollars unless otherwise stated. Invoices are due within four (4) days of issuance. Late payments may result in suspension or termination. Taxes applicable under Canadian law will be added. Refunds are subject to our Payment and Refund Policy.
Termination
simple-webhosting.ca may suspend or terminate Services without notice if you fail to pay fees, violate this Agreement, or engage in conduct that may harm others. Upon termination, all user content and data may be permanently deleted.
Limitation of Liability
To the maximum extent permitted by Canadian law, simple-webhosting.ca and its affiliates shall not be liable for indirect, incidental, or consequential damages, including lost profits or data. Our total liability shall not exceed the amount you paid for Services in the three (3) months preceding the claim.
Indemnification
You agree to indemnify and hold harmless simple-webhosting.ca and its affiliates from any claims, damages, or expenses arising from your use of the Services or violation of this Agreement.
Arbitration and Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the Province of Alberta and the federal laws of Canada applicable therein. Any dispute arising out of or relating to this Agreement shall be submitted to binding arbitration in Edmonton, Alberta, under the Arbitration Act (Alberta). Proceedings will be conducted in English and on an individual basis.
Modifications
simple-webhosting.ca may modify this Agreement from time to time. Updates will be posted on our website with the date of the last revision. Your continued use of the Services after such modifications constitutes acceptance of the updated terms.
